Don't Choose the Default Will

The provincial government has written a will for all of us and it is free, but your family will not like the solution the government will impose. The problem is the direction of your assets - it's not the direction you want them to go. There is good news. If you take the time to write your own will, and some families need two wills to avoid probate taxes, your wishes supersede the governments instructions. How often does that happen!? While I do not suggest planning your transfer of assets without a lawyer involved, you can use a holographic will as your solution. What makes a holograph will valid? A holograph will is only valid if you write it by hand and sign it yourself. You cannot use a computer or pre-existing form. It is preferable to date a holograph will. If you have made several wills, dating makes it easier to determine which is most recent. These wills are legal except in BC and PEI. Holographic wills are a great way of instructing your lawyer on the basics so they can build your formal will.
